IMPORTANT! READ BEFORE BIDDING!
1. REGISTRATION. All bidding is open to the public. However, you must first read the terms and conditions before registering to bid as they are strictly adhered to and contain important information.
2. MULTI-PLATFORM BIDDING. All auctions are conducted simultaneously across multiple online bidding platforms. Bids shown as a “Floor Bidder” represent bidders participating from another platform.You may appear as the High Bidder on your selected platform but must outbid all competing bidders across every platform to win the lot. Platform notifications or pop-ups may not reflect the final result; the invoice issued by Swisher Bros. Auction determines the official winning bid. Pre-bidders are encouraged to bid at least one increment above their intended maximum. However, bidding LIVE during the auction provides the best opportunity to secure your item, as it allows you to continue bidding in real time against competing bidders.
3. PAYMENT. Invoices will be sent within 24 hours after the sale. Please make your payment online where available, during pick up with cash or good check or by credit card (3% card fee applies). Payment must be made within 3 days of the auction. If no payment is made, or payment is declined your account will be disputed and banned from future sales.
4. PICK-UP. Pick up is the Monday and Tuesday FOLLOWING THE AUCTION from 10am to 4pm. Pick up location is usually at our auction house, 471 Frankfort Rd, Shelbyville KY 40065. While you are welcome to set up your own transport service, the pickup conditions still apply. Occasionally pick up will be at the seller’s location, in the event of an on-site pick up, Lot 1 will have the pick-up information, times and general city. The full address will be included on the winning bidder’s invoice to protect the seller’s privacy. On a rare case-by-case basis we may be able to make an exception to the pick-up times for in-house pick-up only. A $10 per day storage fee will apply. Any items that are brought from an off-site location back to our building because of a bidder’s failure to comply with the pick up times will require a $25 transport fee.
5. SHIPPING. Shipping may take 2 to 4 weeks. Bidders with an out of state address will automatically be set to ship unless pick-up arrangements are made during the pick-up days. We ship through a local 3rd party company, Fragile Pack, 502-423-0000. They collect all paid for items every Thursday (subject to change if schedules conflict), take them back to their location, pack it all up and will call you directly to verify the shipping address, collect shipping payment and provide all tracking information. Failure to complete the shipping, refusing to complete the shipping or in the event items are returned by the shipper due to no contact the items will be forfeited, your account will be disputed and banned from future sales, no refund will be issued. Shipping estimates unable to be given by the house and requests will be ignored. You can however, call the shipper directly at 502-423-0000 for estimates.
6. PREBIDDING vs ONLINE BIDDING. All platforms offer pre-bidding. However, you will only be the “high bidder” on your platform. There may be higher bids on the other platforms that exceed your bid. We encourage to you bid LIVE when able. Pre-bidders are encouraged to bid at least one increment above their intended maximum. However, bidding LIVE during the auction provides the best opportunity to secure your item, as it allows you to continue bidding in real time against competing bidders.
7. FORFEITURE OF ITEMS. Failure to pick up items during the scheduled pick-up times, failure to complete shipping or having items returned from the shipper due to not being able to connect with you will result in forfeiture of items, there will be no exceptions.
8. REFUNDS. All sales are final, no refunds, no exceptions. No warranties or guarantees. All items are selling in As Is/As Found Condition.
9. TAXES & EXEMPT. Due to auction website guidelines all bidder’s subject to pay sales tax (either in your state of residence or KY, depending on where possession is taken) unless you are tax exempt. If you are tax exempt, you will need to have the tax exemption documentation already added to your account prior to participating in our auction. Swisher Bros. Auction has no authority to remove taxes off an invoice and the invoice payment will be due in full. Please call the auction site home office for assistance.
10. CONDITION / REPORTS. Items are likely to be previously owned, Buyer must rely on own visual inspection regarding the usability of items purchased. Auctioneer and staff make no guarantees or warranties, expressed or implied. Any condition statement given is done as a courtesy to a potential bidder or Buyer, is done so as honestly and accurately as possible to the best of our knowledge, is only an opinion and should not be treated as a statement of fact. Swisher Bros. Auction shall have no responsibility for any error or omission in description. The absence of a condition statement does not imply that a lot is in perfect condition or completely free from wear and tear, imperfections, or the effects of aging. Any statements made by Swisher Bros. Auction with respect to a lot, whether in a condition report, Swisher Bros. Auction catalog, or on the Swisher Bros. Auction website, orally or in writing, are intended as statements of opinion only, are given as honestly and accurately as possible to the best of our knowledge, are not to be relied upon as statements of fact, and do not constitute representations or warranties of any kind. Any description of a lot’s dimensions and weights is as close to accurate as possible but still an approximate. Descriptions we make about lots may not describe all faults or restorations. No description or report about a lot is a substitute for your own examination of a lot during preview times.
11. ANNOUNCEMENTS. Announcements made on the day of the sale take precedence over printed material or any oral statements that have been made. Once the auctioneer says sold that item becomes yours. All sales are final. Items may be added, withdrawn, updated or corrected without notice prior to the sale date and time.
12. RESERVE. In the event a consignor requests a reserve price, neither Auctioneer, Agents nor the Sellers shall disclose the minimum reserve price. As agents of the seller, we have a fiduciary responsibility to not disclose the reserve price.
13. OTHER. In person federal background checks $10 per application. In the event an item is shipped by us directly the buyer will be required to pay for packing supplies as well as shipping.
14. CONSIGNORS RIGHTS. The consignor has the right to place a reserve on any item. The auction house will not disclose the reserve price. Consignors are also able to update/remove any lots up until the item is sold. In rare instances the item may be unable to be removed from the auction platform due to timing and would be “passed” in the auction. At no time will an item that is passed be sold to a bidder.
15. ERRORS. Any and all selling errors that might or could happen, whether by electronic or human, are accidental and never intentional or malicious. In the event of a selling error the item will be removed from an invoice.

REAL ESTATE ABSOLUTE AUCTION – TERMS & CONDITIONS
1. BIDDER AGREEMENT AND ACCEPTANCE OF TERMS:
By registering to bid, each bidder acknowledges that they have read, understand, and agree to be legally bound by all Terms and Conditions contained herein. Registration and participation in the auction constitute a binding agreement between the bidder, the Seller, and Swisher Bros. Auction, LLC.
All sales are final and irrevocable. The terms of sale are non-negotiable. Bidders are strongly advised to review all Terms and Conditions thoroughly prior to placing any bid. By bidding, the bidder affirms acceptance of all disclosures, conditions, and requirements of this sale.
2. BIDDER REGISTRATION REQUIREMENTS:
All online bidders for this property must call 502-633-6555 for approval after completing online registration and provide a letter of credit to [email protected].
Registration is free; however, a valid credit card is required for identity and fund verification purposes only.
By placing a bid, the bidder represents to Swisher Bros. Auction, LLC (“Auctioneer” or “Agent”), Todd & Sons Real Estate and the Seller that they have reviewed and accepted these Terms and Conditions in full. Any person who does not agree with these terms must not bid, as bidding creates a legally binding obligation.
3. PROPERTY DESCRIPTION:
This property offers a blend of privacy, acreage, and convenience with a three-bedroom, two full bath home situated on just under ten acres. The property is located approximately six miles from Highway 127, allowing convenient access to surrounding communities while maintaining a private rural setting.

The kitchen includes a hookup for a wood-burning stove that has never been used. Improvements include a 30-foot by 40-foot detached building with electric and water available at the site, suitable for workshop, storage, or hobby use.
The real estate sells ABSOLUTE to the highest bidder, AS-IS and WHERE-IS, with no reserve. Buyers are responsible for independently verifying all aspects of the property to their satisfaction prior to bidding.
4. GENERAL TERMS OF REAL ESTATE SALE:
The property is sold AS-IS and WHERE-IS with no warranties or guarantees expressed or implied by the Seller, Swisher Bros. Auction, LLC or Todd & Sons Real Estate. The sale requires hard money or cash only and is not subject to financing, inspection, appraisal, or any other contingency. All due diligence is the sole responsibility of the bidder prior to auction participation.
5. ANNOUNCEMENTS AND MODIFICATION OF TERMS
Announcements made by the Auctioneer on the day of the auction shall take precedence over all prior written or verbal statements, advertisements, or published materials. The Seller reserves the right to withdraw the property from the auction at any time prior to acceptance of the final bid.
6. EARNEST MONEY REQUIREMENT
Immediately upon conclusion of the auction, the winning bidder shall deliver a non-refundable earnest money deposit equal to ten percent (10%) of the purchase price. The deposit may be paid by a personal check that is accompanied by letter of credit from issuing bank or cashier’s check made payable to the designated Title Company. The remaining balance of the purchase price shall be due at closing. Bidding is not contingent upon financing approval.
7. BIDDING PROCEDURES:
All bids placed constitute irrevocable offers to purchase. No bid may be withdrawn once acknowledged by the Auctioneer. Bids remain binding until the Auctioneer declares the property sold and the auction concludes. The Auctioneer reserves sole authority over bidding increments, bidder recognition, and conduct of the auction. Bidder numbers are non-transferable. The Seller reserves the right to accept or reject any bid.
8. ACCEPTANCE OF FINAL BID:
The Seller retains the right to accept, reject, or counter any bid. The high bidder remains legally obligated under their bid until acceptance or rejection is communicated by the Seller in writing. The Auction Company will make reasonable efforts to secure acceptance immediately following the auction.
9. POSSESSION OF PROPERTY:
Possession of the property shall transfer to the Buyer only upon successful closing and full funding. Early possession shall not be permitted.
10. PROPERTY CLASSIFICATION:
The property is classified as a family dwelling with agricultural use.
11. BUYER DEFAULT OR FAILURE TO CLOSE:
Failure of the Buyer to comply with these Terms and Conditions or to complete closing shall constitute default. In the event of default, the ten percent (10%) earnest money/non refundable deposit shall be forfeited as liquidated damages. Such forfeiture shall not limit the Seller or Swisher Bros. Auction, LLC from pursuing additional legal or equitable remedies, including enforcement of the purchase agreement and recovery of damages.
12. ENVIRONMENTAL DISCLAIMER:
The Seller, Swisher Bros. Auction, LLC, Todd & Sons Real Estate, and all affiliated parties make no representations or warranties regarding environmental conditions, including but not limited to pollutants, contaminants, mold, or hazardous substances. Buyers shall rely solely upon their own inspections and evaluations.
13. DISCLAIMER AND BUYER’S DUE DILIGENCE:
All information contained in the Property Information Package and marketing materials is provided for convenience only and is believed reliable but not guaranteed. The property is offered without warranty of any kind, expressed or implied. Prospective buyers are encouraged to conduct independent inspections, investigations, and due diligence at their own expense.
The Buyer accepts the property subject to existing zoning regulations, easements, rights-of-way, and all current conditions. Measurements are approximate. The Seller, Auctioneer, Broker, affiliates, contractors, employees, and representatives assume no liability for errors, omissions, or inaccuracies.
The Auctioneer reserves the right to refuse bidding privileges to any individual not in good standing and to resolve disputed or tie bids by reopening bidding at the Auctioneer’s sole discretion. All decisions of the Auctioneer and Broker are final.
14. ACKNOWLEDGMENT OF BINDING AGREEMENT:
Registration to bid and participation in this auction constitute acknowledgment that the bidder has read, understands, and agrees to all Terms and Conditions stated herein and agrees to be legally bound by them.

In addition to the Real Estate Terms and Conditions stated above, the following terms apply to all personal property offered in this auction, including but not limited to vehicles, equipment, tools, firearms, furnishings, household contents, and all other estate items.
All personal property is sold AS-IS, WHERE-IS, AND IN CURRENT CONDITION with no warranties or guarantees expressed or implied as to condition, authenticity, operability, merchantability, fitness for a particular purpose, or completeness. All sales are final. No refunds, exchanges, chargebacks, or returns shall be permitted for any reason. Bidders are encouraged to inspect items prior to bidding and rely solely upon their own judgment when placing bids and are HIGHLY encouraged to take advantage of the preview dates. Placing bids without taking advantage of the preview dates does not allow a bidder to back out of their purchase.
By placing a bid, the bidder acknowledges they have examined the items to their satisfaction or have voluntarily waived the opportunity to do so. Descriptions, photographs, and statements provided by Swisher Bros. All purchased items must be removed during the scheduled pickup dates of Monday, May 11, 2026, and Tuesday, May 12, 2026, during the designated pickup hours. Buyers are solely responsible for removal, loading, transportation, labor, equipment, and securing of purchased items. Auction staff may assist at their discretion, but all removal is performed at the buyer’s risk.
Any items not removed within the scheduled pickup period shall be considered abandoned unless prior written arrangements have been approved by the Auction Company. Abandoned items may be resold, disposed of, or subject to storage and handling fees at the Auction Company’s discretion, with no refund issued to the buyer.
Swisher Bros. Auction, LLC reserves the right to refuse service, revoke bidding privileges, or deny participation to any bidder not in good standing. All decisions made by the Auctioneer regarding payment, removal, disputes, or enforcement of these terms shall be final.
